Don’t Let Debt Collectors Harass, Intimidate

Everyone knows that ignoring debt collectors’ calls is not a good idea. Refusing to answer and negotiate with them can just make the situation worse. But when it comes to their collection tactics, you should know your rights.

Federal standards

Under the Fair Debt Collection Practices Act (FDCPA), the U.S. Federal Trade Commission (FTC) has published educational materials about your rights when dealing with debt collectors. And if these rights are violated, you can report the collectors to your state attorney general’s office and submit a complaint to the U.S. Consumer Financial Protection Bureau (CFPB).

Harassment

Under the FDCPA, it’s actually illegal for debt collectors to harass or threaten you. This can include making nuisance phone calls, making threats of force, making threats of violence, making threats of taking your property (except in cases of legal repossession) and even using abusive language. And if you demand in writing that they stop calling you, they are required by law to comply. If they don’t follow these rules, you are entitled to file a complaint with the CFPB about their actions.

Illegal collection practices

Some collectors go even further in their collection tactics. Recently, some Pennsylvania collection companies resorted to illegal methods to collect debts, so beware of this potential and consider having an attorney evaluate any actions taken by your collectors. Some collectors have been known to gather information or inventories about debtors’ income and assets, to issue fake subpoenas ordering debtors’ appearance in court for an unscheduled hearing about their debt and to impersonate deputy sheriffs when delivering or serving fake subpoenas.
