Chapter 13 bankruptcy qualification is determined by the federal Bankruptcy Code. First, your debt load is limited to:

  • $1,081,400 in secured debt — property loans such as mortgages and car loans
  • $360,475 in unsecured debt — general debts such as credit card, utility and medical bills

Second, you must have a stable income that leaves you with disposable income to make your Chapter 13 payments. Disposable income is the amount left over after you pay for the basic necessities of life, such as food and clothing. The major advantages of a Pennsylvania Chapter 13

If you can afford to file for bankruptcy under Chapter 13, it is usually preferable to Chapter 7 because:

  • You have the protection of the federal Bankruptcy Code
  • Your total debt obligation is reduced
  • You can pay back your secured debts through Chapter 13
  • Creditors are required to accept less than you owe

None of the above benefits are available through the debt consolidation plans offered by CCC providers.
